This was probably written by aywas staff - if this were written by nintendo it would have legalese slathered all over it and they would be more specific than "those sort of games". You can't find it in the EULA because this text is not written by Nintendo.
Nintendo has absolutely no way of knowing why that person gave me this pokemon, especially if the deal was set up privately on a third party site. Also, players cannot "gift" other players with free pokemon - both users have to give something in trade. For all nintendo knows, the trade is legit. A prearranged cross-site trade looks exactly like my friend gave me a nice pokemon.
Aywas also never explained how they arrived at the conclusion to ban these kinds of trades based on any EULA, nor did they quote any specific text out of any EULA that helped lead to that conclusion, nor did they link users to any EULA they used to reach this conclusion (there are EULAs for each device). I read through my 3DS XL EULA and came to a completely different conclusion - that I do these trades at my own risk, since CS is a third party site and there is nothing barring me from prearranging trades with other players. I don't even appear to be violating the simple code of conduct in the 3DS XL EULA.
Yeah...I'm really questioning this because there is no way for me to understand why this conclusion was reached, and I should be able to verify it.

I think the primary reason Aywas probably banned it is because pretty much all Pokemon purchases were being done with GP, which is Aywas USD-bought currency...so it's basically indirectly buying Pokemon for USD (even if you didn't actually buy the GP yourself for USD, which a lot of people aren't).
It's still pretty dumb (what, are they going to go sue every dumb kid that decides to trade their Pokemon to a classmate for, like...a buck?), but whatever. I see no reason to completely ban trading Pokemon for CS pets, currency gained without spending real money, etc. They just don't want people making actual REAL money off their IP.
