well if they just didn't do their side and/or called the deal off, it's is your right to do what you please with the character even though they requested it made a specific way. you can always offer to sell it to them first and if they decline then have your way with the character. that is if the character is already completed. if not then continue to finish the character but not to their specifications and sell/trade/keep it.
