What do you do if you sold someone a character, had a rule that they needed to return the character to you if they no longer wanted it, but they are still trying to sell it, despite your efforts to contact them?

I think if it was a clear rule from the beginning, and you had tried to contact them several times, you should probably contact a CS mod since they aren't following the artist's rules...

        I've encountered this a few times and it's always extremely stressful and upsetting. I would attempt to PM them a few more times but also send in a help ticket to the CS mods. So long as you have proof that the rule stating that they need to return it to you if they no longer want it was created before you sold the design, they legally cannot sell the character and the CS mods should step in. Make sure to have some screenshots of the sale/dates as well as when the rule was created (though I believe mods can check to make sure the dates you give them are correct since they can see edit logs I believe) and then all should be good C:

    To be honest I don't think many people will agree with me on this, but I feel like if you sell something to someone, it's their right to do what they want with it so long as they don't go altering any artwork. Once you sell a design, you're giving away ownership [ unless co-owning ] and thus you can't really tell them what they can and can't do. They paid to get ownership, not partial ownership that allows you to have a say over what happens to the character afterwards.

    This is just a personal opinion of course, don't kill me ;;A;; I just find it kind of unfair that a person has any say over someone else's character, whether you designed it or not. You got profit, they got a design they like, so why not just leave people be after that ? ;;A;;

    Dunno, I can see both sides. :3 I feel like, if someone promises they'll return the design to you, instead of reselling, they kinda shoudl v w v ;;
    In some cases, I'm reluctant to give up a design- so I'll compromise to myself, by letting the design go to a great loving home, and I know if they ever fall out-of-love, I'll be able to get it back, without worrying it'll disappear in a swirl of sales / trades / etc.
    Tacking on a rule like that after the fact, though, or without making it clear when selling, I would definitely say is not OK ^^
    I get that they're buying the character and all, but I would hope they're buying it to use, not to sell ^_^ Enough so that they figure, they're going to really love it for while, so they won't mind not being able to profit off it. C: If they don't want the character enough to get over the fact that they can't sell it for a quick profit, I wouldn't want them having it anyways X3
I'm traveling til Friday w/ no access to my tablet!

        I just wanted to address something here quick :'D Because you honestly make a really really great point <3

        I typically look for characters that DON'T have any of these clauses attached to them, since once I buy a character I want the ability to do whatever I please with them. That being said, if someone has very clearly stated terms, which SAY that you may not resell/adopt out/etc. Then that's like signing any contract or terms of service thing. If YOU aren't reading the fine print then that's too bad for you, I personally think rules like that can be a bit ridiculous, but if you buy a character under those terms then you ARE agreeing to them and are saying by your willingness to purchase the character that you're okay with the terms the seller has presented.

        Should the seller have the right to make that a condition? That could be debated and questioned, but if you buy a character under those terms then I'm quite sure that (legally) you have an obligation to follow through on those terms. (just my two cents xDDD)

Unless you're the artist, you can't really add rules like that on. Only the artists have the right to make rules like that. If I cared about a character to the point where I'd ask them to return it if they no longer wanted it, I wouldn't sell in the first place.

I kinda agree with you on this. If you sell a characters, you decided that you don't want to own it anymore, and you agree with the fact that once the design is sold, you won't have any control over it.

In "real life" there can be such rules as well though. For example we once sold a horse and wrote in the contract that if the new owner will ever wanted to sell him again he HAD TO ask us before any other person so we could have the opportunity to buy him back if we wanted to.

In general I don't see the point with some rules people use.
"I made up a design for auctioning and want the sell it for 30 USD.
BUT if you purchase it you aren't allowed to change the design or gender, it can't be your fursona, you can't breed it, trade it, resell it and if you no longer want it you have to give it back to me, but you won't get any money back."
Just lol.

I understand your point as the artist or previous owner that you still want to have the possibility of a certain amount of control over your work, but you have to know: If you even sell something, it's gone.
Selling = business, even on the Internet with online currency

It's also kinda unfair to the person who buys. You take their money, but you prohibit them almost anything you can do with a character.

Sorry for the long post, but this makes me mad everytime I see something along those lines :/
