Most bands have one member who makes their own album but they can stay in the band while doing that. Gary Barlow did it, so did Ronan Keating and they're still together.

He's apparently going to do it in 2014 so theres stilla while to wait.

because they can still break up, can rip the contract up, but i doubt they would

They can't, management would be able to sue them. When you sign a contract you can't ever go back on it.
