Send it back to them. If they accept, its a gift. Thats what I did with a coppa'd user once.

That's what I did, and explained why I sent it back, and suggested naming gift pets "Gift" in the future to avoid confusion. I worry about things like that, especially when I get offended by people cancelling my gifts or turning gifts into trades. I had someone send me a trade with a pet I REALLY wanted in it, asking me to edit. I had to fight hard not to just accept, and I sent it back explaining. Sometimes it really sucks to have a conscious.
