Terms of Service
Introduction
Please read the Terms of Service (“Terms” or “TOS”) carefully. They contain legal terms and conditions that govern your use of services provided to you by Shadow Eclipse, including information, text, images, graphics, data, or other materials(“Content”) and services provided through www.ShadowEclipse.com as well as all elements, software, programs, and code forming or incorporated in to www.ShadowEclipse.com (the “Service”).
By using our Service, you agree to be bound by Section I of these Terms (“General Terms”), which contains provisions applicable to all users of our Service, including visitors to the Shadow Eclipse website (the “Site”). If you choose to register as a member of our Service, you will be asked to check a box indicating that you have read, and agree to be bound by, the additional terms set forth in Section II of these Terms (“Additional Terms”)
Section I: General Terms
1. Availability
This service is provided by Shadow Eclipse on an “AS IS” and “AS AVAILABLE” basis and Lunar Eclipse reserves the right to modify, suspend, or discontinue the Service, in its sole discretion, at any time and without notice. Shadow Eclipse reserves the right to shut down, sell, trade, or otherwise disown the site at any time with or without notice, permanently or temporarily at any time. Shadow Eclipse also hold the right to make the site private, or inaccessible for whatever reason, be it beta testing, bug fixing, or for administrative reasons. You agree the Shadow Eclipse is and will not be liable to you for any modification, suspension, or discontinuance of the Service.
2. Content Rights
All content, coding, scripts, documents, and other text are copyrighted to Shadow Eclipse. All graphics and adoptable lineart are copyrighted and trademarked to Shadow Eclipse. No copyrighted or trademarked content, graphics, text, script, can be duplicated, used, sold, edited, or claimed without written permission of Shadow Eclipse. Shadow Eclipse also holds the rights to redraw any graphics and/or redesign any features or games within the site.
When there is content you submit or make available publicly for Shadow Eclipse, you grant Shadow Eclipse royalty-free and non-exclusive license(s). You grant Shadow Eclipse the right to use, distribute, reproduce, modify, adapt, redraw, and publicly display any content you make available.
Unless hired by Shadow Eclipse, any graphics or photos you provide will not be directly accepted or uploaded. Official Shadow Eclipse artists will redraw the graphics and/or photos in question.
By submitting ideas, suggestions, documents, photos, or pictures to Shadow Eclipse, as a user you are responsible that all content does not contain confidential or proprietary information. User agrees that all content automatically becomes property of Shadow Eclipse without any obligation of Shadow Eclipse to you. You are not entitles to any compensation or reimbursement of any kind from Shadow Eclipse under any circumstances.

3. Privacy
Shadow Eclipse tries its best to provide a safe site and protect the privacy of all its users. Shadow Eclipse allows for individuals over at least the age of thirteen to do certain thing being communicating with others. Age and email are required within registering as well with consent of being allowed to register prior of the legal parent(s) or guardian(s). As legal guardian(s) of your child, it is your responsibility to determine if Shadow Eclipse is appropriate for your child. In addition, there are no areas that are described and/or restricted as 13 years or above on Shadow Eclipse.
When using any services provided by Shadow Eclipse that require information such as purchasing shadow coins (“$SC” or “SC”), you agree to provide true, accurate, current, and complete information about yourself. If you provide any information that is untrue, inaccurate, not current, or incomplete, Shadow Eclipse has the right to freeze your account and refuse any current or future use of services.
4. Privileges
All users are granted certain privileges, not rights, that can be taken away at any time for any reason with or without warning or explanation. Privileges include things such as an account services provided through the site such as forums and private messaging, owning pets, obtaining items, buying Shadow Coins, participating in events, using the Art Canvas, trading with other users, and other features on the site. Any violation to TOS may result in all privileges being revoked and account being permanently frozen. TOS applies to all users regardless of ranks.
5. Funds
Shadow Eclipse runs a small business type through PayPal (http://www.paypal.com). Unless stated otherwise, no other payment types will be accepted. (this includes snail mail) Users that plan to purchase Shadow Coins agree that they have permission and right to use the PayPal account in their possession and that they have permission to spend the available funds. User also acknowledges that no refunds will be issued at any time and PayPal Charge backs result in AUTOMATIC PERMANENT BAN until charge back are reserved in full or to the satisfaction of Shadow Eclipse.

Section II: General Rules As A User
1. Registration
When registering, you are to provide a username or nickname, password, email, and birthdate for your account. The following fields that have been listed MUST be filled out in order of registration for an account. We are not held responsible for whatever information that you enter for your account. It is best that you keep your account protected from being hacked as also for accepting what you think is fair or unfair when communicating or interacting with others. Your birthdate will be recorded into your account to approve or disapprove as well as limit your options and restrain you from doing certain things. We ask that you put your true age. If you are found lying about your actual age, you will be suspended or banned for false information, depending on the situation or troubles you may have cause the staff or other members.
For users who are 13 years of age and/or older, you are allowed to send messages to other users and post in the forum. For users younger than the approved aged users are NOT allowed to send messages to other users and post in the forum.
Users are allowed up to one account of registration and ONE ACCOUNT only. Users may share accounts, however, the shared account is still considered an account for both users. Should the users share one account, they are not entitled to another account for their own. Users are held liable for their own actions and actions of said partner(s). If a partner breaks the TOS and causes the account to be frozen, both users are at fault. Shadow Eclipse will not reimburse virtual items, virtual pets, etc. to individuals who claim they “did not do it”.
Individuals who wish to have their brother, sister, child, cousin, or other family member join the website may do so. There are no restrictions here. However, the one account per user rule still stands. Family members may not team together over any events, games, etc. to get an unfair advantage.
Should a user lose access to his or her account, they may contact an Administrator to receive access information. The user will be required to provide evidence that the account is theirs. Evidence such as virtual items in inventory, messages in an inbox, pets, or other information that cannot be obtained by someone is someone who does not have access to the account. Shadow Eclipse will NEVER ask for a user’s password.
2. Site Features
Shadow Eclipse features the ability to trade pets and items with others. Whatever a user owns on their account may trade what they wish to on their own account and notability. The staff is not held responsible for what a user offers and does happen to give away.
Shadow Eclipse also enables the ability to communicate with others through the forum and private messaging. When it comes to the forum, everything must be all age appropriate and is monitored by staff to keep everything in check and friendly to all users.
The site also features an Art Canvas provided by (ENTER NAME OF ART SITE/PROGRAM HERE). Users are allowed to create and save art they have created as well as let others edit it as long as permission is given to. All copyrights must be given to their respectful owners for whatever content would be drawn as well as it’s appropriate to all viewers.
3. Users Conduct
All personal information must remain in your hands to protect your identity. Users are allowed to communicate with others and give out personal information and identity, but you put your own identity at your own risk. We will not be held accountable for any information you have released to others since you are held accountable for releasing whatever information you have given out. What falls under your personal information includes you full name, city, residence, school/work, age, birthdate, and so on.
Shadow Eclipse provides a public forum for all users to use for many topics, discussions, or debates. The forums are monitored hourly by moderators. All content is attempted to be child friendly, however, due to different personalities and opinions, Shadow Eclipse cannot be held responsible for any distress caused by user made threads. It is asked that if a user stumbles on an offensive thread or violation of TOS it should be reported immediately to the staff so an action can be taken.
The following rules must be followed while posting on Shadow Eclipse and should any user neglect to follow these rules, they may be fines, temporarily banned, or permanently suspended/frozen from the site.
-No topics about religion or politics, as these lead to arguments and fights among users. Any discrimination against races, values, genders, etc. are prohibited to be posted nor be used as a topic under any circumstances.
-There is to be no spamming, which includes the multiple creation of the same topic. There is to be no use of posting/creating multiple topics of the same thing in a forum topic. We also ask that no one is to spam posted topics either. This includes posting one word posts in a multiple row that combine to make a sentence and as well as posting one sentence in a post. There is a reason why you are given the option to edit your post in a forum. Spamming the forum posts or threads will result in deletion or locking of the threads or posts. Begging other users is also a prohibited thing to do. Your thread or post WILL be deleted or locked. If one user continues to beg consistently, it is to be reported and will be dealt with. Spamming a lot will lead to a temporary ban or restriction for a certain amount of time.
-Images or content posted or linked to such as pornography, yiff, yaoi, a lot of gore, or any other any mature content is prohibited. If failure to follow this, you will be banned or suspended.
-Impersonating a staff member, another user, or entity in any way is unacceptable and will be taken seriously. You are not allowed to say you are a mod or will be a mod either, nor shall you beg or bribe a staff member to try to be part of the staff. Becoming a staff member is by choice of the current staff along with consent from the head leader or officials of the site. Doing so will get you immediately suspended from the site. If any of the following is seen, immediately report them.
-Users are not to post any swearing/cursing, abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated, or any other material that may violate any laws be it of your country, the country where “Shadow Eclipse” is hosted, or International Law. Doing so may lead to you being immediately and possibly permanently banned, with notification of your Internet Service Provider if deemed required us. You agree that Shadow Eclipse has the right to remove, edit, move, or close any topic or post at any time should we see fit. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, Shadow Eclipse will not be held responsible for any hacking attempt that may lead to the data being compromised.
All staff members will have the ability to enforce the TOS and users are to respect and listen to them. You are allowed to contact a staff member to discuss actions the user feels are unfair. It is important that if you see any violation or the TOS or forum rules that you ask a staff member about it or report it immediately and will be handled as soon as possible. Users are to remember that this is a site in which all ages are allowed to register on and are able to visit the forums with their posts. All content must be rated appropriate for all ages, regardless of what you may think is appropriate in your own opinion.
4. Onsite Content
No images, coding, nor content is to be manipulated, traced, edited, or stolen in any way. Any claiming of content on this site as your own is illegal and will not be taken lightly. If such is seen anywhere offsite, report the content to the staff and we shall investigate. Any images used in your profile or submitted in the Art Forum that is not yours is to be copyrighted to the resected artists, creators, owners, companies, or users. Any art that does not belong to a user will be warned and is to take it down immediately. If this issue is to continue within a certain user, an action will be taken in account. Shadow Eclipse will not take responsibility for images created and submitted by users. As a user, you must copyright to the respective owners of any art or characters, who it was drawn by and to whom it belongs too. If a user is found claiming something as theirs, it’s important to approve that it is theirs from the start or not in order to be dealt with. Any false accusation will not be dealt with and will simply be ignored. Be sure that what you are claiming is true before trying to contact a staff member.
5. Trading For Different Content
Shadow Eclipse allows trading of its virtual goods for other currencies of other websites that ALLOW TRADING WITH OTHER WEBSITES. Shadow Eclipse cannot be held responsible for poor decisions or otherwise faulty/scammed trades when trading your virtual virtues for other virtual virtues from other sites. Shadow Eclipse will not reimburse any stolen/scammed virtual virtues as well when involved with other website virtual virtues.
If evidence is provided that a user has offered, traded, or sold Shadow Eclipse property for real currency, Shadow Eclipse holds the right to freeze all accounts, buyer and seller, involved in the transaction(s).
Users may trade with other users for what others are looking for or offering such as art related content of any kind.
6. Attempts of Cheating/Hacking
Any attempt of cheating, hacking, or modify the Shadow Eclipse security will result in immediate suspension. Same goes if you also trick a user with any false information that you incorporate as true. Report any such to a staff member and we may reverse a pet trade if that is what has happened. If you accepted a trade by accident in any such way, you must have a good enough reason on how it happened and why it should be reversed. If you were somehow hacked and had any account information, items, or pets changed/traded off, report to us about it and we will reverse/recover any loss and will deal with the hacker if possible.
If a glitch/bug is found, report it immediately. If users take advantage of the glitch/bug, it will result in an IP ban.
If a user is found trying to test against the Site’s security, investigation into why and who is testing against it will be permanently suspended for trying to do so.
Various features on Shadow Eclipse are offered to provide the user a trustworthy legitimate way to sell and/or trade Shadow Eclipse currency, items, and pets with other Shadow Eclipse users. Any other user that intentionally scams another user will be fined, temporarily banned, or suspended for such actions. Where Shadow Eclipse will attempt to reimburse any stolen/scammed virtual properties lost on the site due to vicious user(s), there is no guarantee that reimbursement will be successful.
User may also be held responsible for abusing system glitches or bugs found on Shadow Eclipse. It is requested that users report all bugs to the staff and hold any duplicate, illegitimate, or virtual properties that shouldn’t exist off to the side so that a staff member can resolve the problem.
Agreeing to the Terms of Service of Shadow Eclipse signifies that you, the user, have read, understood, accepted, and agreed to the above TOS. Any violation of the TOS may result in a fine of virtual currency, temporary bans, or permanent suspension from Shadow Eclipse. Shadow Eclipse holds the rights to modify, change, add, or subtract any contents of this TOS with or without notice, or explanation. It is the user’s responsibility to frequently check the TOS to see if any revisions have been made. If the user does not agree, accept, or understand the above TOS, user is the immediately cease use of this website.

Uses For This Thread:
-Contests are held by people who want art for their characters, looking for a design for a character, or for lineart that users would like to be able to use for their personal use.
-Some users use this thread to hold contests for stories, art of a species/creature, icons they can use, or just to hold a contest.
Rules Contest Holders MUST Follow:
-Prizes MUST be handed out if people enter unless it’s a design contest in which entrants get keep their entries.
-Do not change the prizes you are offering without warning they’d change in the beginning.
-Contests should be scheduled to end in a months’ time if an end date is not provided.
-Design contests where all entries would be kept, a prize must be given out to each participant for the work they did.

Important Things A Contest Holder May Want To Include:
-In the beginning, clearly state that “Prizes May Be Subject To Change” if you’re planning on changing/adding/subtracting/substituting the prize. Users may get mad if you change the prize without a future notice to warn them.
-State that you might end the contest without a winner, but this rule only goes towards design contests and artists should be able to keep their entries.
-State that you would be keeping all entries you receive if you are planning to do so.
-How many entries entrants may enter.
Rules That Contestants MUST Follow:
-If you plan on copyrighting your art, sign it somewhere close to the main image or so.
-Do not argue with the rules/requirements the contest holder has for their contest
-Do not whine/beg for the prizes if they are not yours to get as well as whine if you had gotten a prize you did not want; don’t enter the contest if you don’t like the prizes if that’s the issue.
-Provide a working link to the image/document so it can be seen by the contest holder/other contestants.
-Do not make fun or judge others art
-Provide copyrights to the rightful owners of the characters you are drawing/writing about.
Report A Contest To A Staff Member Immediately If:
-A contest ends without warning
-The prizes of a contest are changed without warning
-The contest holder hasn’t logged into their account in a long amount of time, as the staff will have to judge the contest and hand the prizes out.
-A contest holder will not give up the prizes they had offered and did not say that the prizes may not be given out or changed.
-The contest holder keeps extending their contest even with so many entries and will not judge,

-Do NOT trace the image, that can get you banned.
-Simply follow the composure of the image by using shapes to make out the figure of the body.
