The problem was that the dragons were clearly the book's dragons, not simply dragons inspired on them. The same issue happened to the sitting cats, they were literally characters from the warrior cats books. CS has no permission to use someone else's designs/characters and that's what the copyright issues were about.
Whenever an artist takes inspiration from a source material like a book series, game franchise, movie, etc. they are required to make the pets' designs as abstract as possible(like my Sonic and ghibli litters), this way we won't be crossing copyright territory by using a character design that doesn't belong to us.
nickjr wrote:For reference, here is what happened with the "Warrior" cats. tl;dr is that the lineart is fine because it's Tess's and the "Warrior" designs are fine because they are ultimately generic cat designs, but the problem was displaying the official Warrior cat names and the overarching name "Warrior Cat" in conjunction with the designs.
I wasn't around to see what happened with the Malk dragons, but my guess based on what I've read here and there is that the issue is with neither the lineart itself nor the color designs. I think the issue is the concept/growth progression? As in, the way the dragons grow is precisely like how they grow in the books. Since, as far as we can find, dragons are mythical creatures, there is then a lot of wiggle room for how dragons can grow. So when the growth progression matches exactly...
Someone PLEASE correct me if I'm wrong.
edit: I just found something that says Tess added a link to the dragons' pet pages that explains where the dragons came from. Did this lead to a similar situation as the Warrior cats?

Being based on books isn't copyright. Having lines traced is copyright and Malk didn't do that.
Can't wait to see the dragons! ^.^
I haven't found the original posts dealing with the issue, but based on what I've heard the author wouldn't have had a legal leg to stand on. So I very much hope this new Malk dragon has the original lines and grows fully.

I swear nickjr you and Zel are fountains of info and I adore you both so much for it.
From what I’ve heard that was the problem, but I’m very confused. They look like any other dragons for me, what’s so ‘special’ about their growth exactly?

Coalchaser wrote:The issue was with the designs of the dragons being based on the book series. The lines themselves are fine; they were not traced. However, the fact that the outcomes were based on specific characters combined with the growth stages matching the growth of the dragons in the books created a copyright issue, especially since they were declared to be based on the series by the artist.
This was a long time ago now and my mind is a bit fuzzy on the details, so please correct me if I'm remembering something incorrectly. I just want to clarify that the copyright issue doesn't affect the use of the lines. I believe malk made the decision to stop using the dragon lines for a while because of the copyright issue, and then ended up retiring so we never saw the lines return.

Avianahelena tries to navigate using the stars, but every time she looks up the stars seem to change.

I'm not familiar with dragon depiction in fiction/art, but just from my head I can think of various growth progressions.
Hatching - tiny? medium? large? fully formed? no wings? no scales/feathers/etc? no teeth? tail size? how to break out of shell--by beak? teeth? head? all at once like an explosion? or maybe they just come into being lol
Growing - follows from hatchling form: order of development of various features (wings last? first?)
Adult - I mean we can see even on CS that there are various possible depictions of an adult dragon lol
If these weren't just pictures, then we could also get into dragon behavior/socializing/rearing: group species? rear the child "tenderly" or "forcefully" (labels that a human would give, for ease of understanding)? non-adult dragon behavior--needy? independent? when?
There really isn't a "typical dragon" or "generic dragon" unless you narrow down which culture/area you're talking about (we can even see this in the various dragon types on CS)

Haha, you still are, though. I've been technically on this site since 08 but I know nothing about the nice details of everything and drama and etc that's happened. ^^"
There's a lot of room for dragons, I meant that I've seen a lot that are sort of similar to the malk dragons just drawn from people who are avid dragon lovers: long tail, wings like that, four legs, etc. (tbh it's my favorite sort of dragon to see so I have personal fondness for any dragon like it) So I guess I'm wondering why these are copying the AOF dragons in their growth. ^^ I never read the books myself so I wouldn't know.Coalchaser wrote:The issue was with the designs of the dragons being based on the book series. From what I've been reading up on it this sounds about like what happened. ^_^
