Also; if someone adopted a character from the Agency; would they be allowed to adopt it out privately to someone else? I know someone who's doing that with all of their characters. :/

Yes, c: Forms that don't meet requirements are disqualified for that round so the design won't necessarily go to them even if they meet those requirements before the next code drop.
