What do you do if you sold someone a character, had a rule that they needed to return the character to you if they no longer wanted it, but they are still trying to sell it, despite your efforts to contact them?

contact a mod on the site with proof.
if you put the rules on the OC then they should follow it

with selling my own OCs [actually more like giving it away oops] i make a rule that they have to ask my permission before selling it or w/e ovo
usually i'll say yes, but it's just in case i may want the OC back??? idk i'm a weeg haha
and they're completely free to return the OC to me ovo
but what i do ask that they do not gain a profit on an OC that they got for free if they didn't get it any art or anything like that because??? you're just using that OC for profit?? they can gift/donate/trade it though

like it's not mandantory at all that you give it back to me or anything but just contact me first so i know where the OC is going or if i can snatch up the OC if i want him/her again rofl. tbh i'd just pay what they paid for the OC + more if they have art ovo
like if you're not gonna pay the OC's original price + the price of any additional artwork then why should you get the OC back, really? ovo

tbh, I don't find it especially unfair. They don't mind the terms, and they're willing to pay it for the character with those terms. If they find it too unfair, they wouldn't buy. .___.; You're not forcing them to buy anything, but if they want the character badly enough that they don't mind a few terms, then they buy it ^^; If not they don't. C:

What do you do if you sold someone a character, had a rule that they needed to return the character to you if they no longer wanted it, but they are still trying to sell it, despite your efforts to contact them?

I honestly agree a lot with Harli and Ravetta. Here's my thinking on such matters. Technically, if someone is buying a character from you, they're kinda buying the rights to use this character. If you have the rules that, when they don't want it anymore, you have to give it back, then that's more loaning the character than actually selling it. Plus, more so than that, if you feel the need to add that rule, why not just not sell the character, especially if you won't offer that person a refund. That's like stealing, in my opinion.

When I'm selling a character, instead of rule, I make a request. I ask, politely that, before they sell the character, they conatct me just to let me know that they are selling it, so it gives me the option to buy it back. They don't feel like they are aggressively bound to any rules, and if I feel like I made a mistake selling that character, I can buy it back.

I feel that's the most fair route. Rather than ordering them to give it back to you, you get to know when they're selling it and possibly buy it back. *shrug* But that's just me.

    i think you're missing the point that they're not supposed to be reselling it in the first place. it shouldn't come to whether or not it's unfair for the next buyer since the character isn't supposed to be sold anyway.

    also, i don't think i ever showed off this splendid character i bought from boat a while ago!

    You have to read through the whole conversation, I had to crop out most of the post I was responding to ^^ It'll make more sense then ^^ It was just a discussion about how fair such rules, as shown in the question, are in the first place ^_^ ~

All of this ^^^^^ is the reason why I simply don't buy characters from people who have a lot of rules attached to them.

While it is wrong to break an artist's rules on a moral level, and you did buy the character agreeing to those rules, I don't understand why the rules are put in the first place DX

I sell a lot of designs, and when I do, I always specify the new owners get free reign of the characters. I don't understand charging someone for something and then telling them what they can and cannot do with it. If I or someone else paid any amount of money, pets, etc for a design, then I really expect the old owner to sever ties.

Just look at Xbox One for a stupid real world example - they tried to make it so that you couldn't resell video games into stores like Game Stop, and the results were that their competition got a lot of really great press attention, and a lot of hardcore Xbox fans jumped ship. So think of all the sales you're losing (like sales from people like me *cough*) when you're attaching all these rules.

I do the same here. I've been on the wrong end of something like this before because I very stupidly didn't read the fine print, and it was really quite troublesome. I never use rules like that, but if it is a character that I may regret selling, I'll ask they contact me in case I want to buy it back. I'd never just take something back, unless it was stolen from me (of course) but that's a completely different situation XD

But in this situation, contact the mods. If they're willing to work it out with you then that's fine, it could have just been a misunderstanding, but if they are deliberately ignoring your messages then it is like a contract. They should stick to it.

    For me, though, I attach rules all the time, and I have plenty of buyers. It makes me feel better, works for them, and everything's good. I don't feel bad because I make my rules clear, so if they don't like 'em, they don't buy. If they're willing to pay what I'm asking for a character they can love and spoil, that's great. If not, plenty of others to fill their place, so I couldn't care less. Rules are only an issue if they don't like it anymore- and honestly, generally they keep liking it for a while, if not forever, so it's really not a big deal for me.
    While I agree that it's a valid point rules can be annoying, even obnoxious if they're super restricting, I don't understand the use of "unfair". Both parties agree to the arrangement and rules- I'm not pulling the wool over anyone's eyes or tricking them or anything. If they buy the character, they're fine with the rules. uwu

    ah, t'is so! sorry for that, i read it in the wrong context - actually, i have to agree with you now on this one. the person that wants to buy the character isn't forced to, and purchasing a character is out of free will, so, if there are rules and you buy the character, by buying it you are affirming these rules. if an artist wants to put rules on their characters then so be it, let them. you are not being forced to buy it, so if you can't abide to the rules then don't buy it.
