Whoever has the rare rat is loosing out, as rares, even though the other is offering a '09, are worth more than that.

Unfair to you. From what I have seen, the pink malk dog is valued quite highly, so I would say take some stuff off your side

Hmm, the rat is older, but Tess dragons are very popular, and rarer. I would say that the user with the dragon is loosing out.
What would they need to add then? C:

An uncommon from '09? I don't really know what will make it fair, just that that isn't fair.

Nope. It was unfair to the Malk cat by itself, not even mentioning the CS 2nd Birthday Tess lineart one. The first pet is worth way more than the rat (it's a retired lineart btw), it's also way older. The rat is a late 2010 and rarity tag doesn't really play a role here.
