I was planning on having popular CS dogs and some well known CS pets on mine, but I was thinking I could include Avian if it would help me.

No. The cake is judged on whether or not it is CS-themed, not on whether or not it is Avian-themed. Avian is a good way to represent CS, but so are plenty of other things, so as long as your cake is clearly decorated in honor of CS's 3rd birthday, you don't need to worry about it. C:

Being banned for both cheating and art theft in a major competition in hopes of winning money, pins, and a custom? Maybe a little strict, but when you think about it, you're essentially commiting plagiarism in order to get cash-equivalent prizes.

Maybe a temporary ban (like 1 month) should be enough.
If they are punished it means that the staff found out that they were cheating so nobody get scammed of RL money.

I'm not really in charge of this stuff; I do understand the reasoning though, so I'll defend it as best I can.

Already, there have been some members who think they can do no work and get away with cheating in a major contest. If they aren't caught, they'll essentially be scamming CS out of money as well as taking prizes that really ought to go to other users who actually put in a lot of effort. But more than that, if they're willing to cheat on such a large scale, they'd probably cheat on a smaller scale, too.

Also, the threat of being banned is there not only to punish the users who attempt to cheat, but also to discourage others who might otherwise cheat.

In any case, there is a big notice that you'll get banned for submitting an image that isn't your own, so if someone ignores that warning, it's really their own fault. No one who doesn't attempt to cheat is at any risk of being banned due to this contest, so it shouldn't be a problem what the penalty is.
