Tess explains on the front page that yes, the images were traced, not just referenced and yes, the photos were copyrighted by their owners. No credit was given to the photographers either.

With all this controversy of why the "background" was left off the birthday fox I can only think of two main reasons.
1. The brush that was used could not be found/needed to be credited in some way (which means CS can't use it unlike someone on, say, DeviantArt could. Everything on CS has to stay original and unique to the site. Which is why a traced lineart can't be kept in the first place...) I highly doubt that Shima painted that fancy background herself. Even if she did, well, it's not like CS could copy it exactly anyways. It would be slightly different no matter what.
2. I don't think they wanted to have the pet be all that "congratulatory" to the artist that made this a problem in the first place. That may seem a bit rude and/or harsh, but the only reason there was a problem at all was because of what Shima did...
They still credited her for the design in the archives, which in my opinion is more than fair. She gets credit/claim for the design on the lineart just like any other "guest artist" would. Nothing more needs to be said or added.
If anything if they WERE to add a background to it then it should just say "Happy Birthday!" with no name...
Which...I'm sorry...but I may be alone on this one but I'm not a fan of pets with pre-made backgrounds. It really does make them a pain to dress up and I, personally, find it looks tacky. Again, that's just my opinion and everyone is free to have their own but making the pets consistent (not only for dressing up but lineart wise too) is just yet another reason to not add it in.
YES I do get where everyone is coming from as to now it's "not the same pet" or "as original" especially since we have 2 new blue Fennec's, but honestly guys you can't blame CS for just trying to "wipe their hands clean" of a past problem. I'd have done the same if it were me. :T

There's two pets that doesn't have "Happy Birthday" written in the background (Fiery Gatoh's cat and Nick's fox (although it has a balloon on it's tail)) and I haven't seen new players getting confused with those pets. I mean
because it's listed in the Staff Birthday selection I don't think you need to clarify any more than that.

I really love the revamp of the birthday fox. The other three are wonderful, too, don't get me wrong, but dang.
The growing stages of the valentines foxes are sooo cute. Makes me wish we had pps versions of them!

Have you taken any if your art work to th copyright office?
It is not thst expensive, and if someone takes your work you have a stronger case for a lawsuit.
If you did not take your works to the copyright office, you won't mind?
