ok what if there was a chicken smoothie trading card game??? and it had iconic pets in the set and there were holo cards and full art cards!!!!!!!!! in booster packs to collaect and play. i would buy a lot of booster packs! pleassse? if you think its even SLIGHTLY a good idea i can do a lot of designing the art/gameplay! pets like sunback and pastel dog and red x and the wooden puppet store pet one and skelebun. is this a good idea?

Perhaps it could be a limited run instead of an indefinite thing, like people could place pre-orders and they could manufacture a certain amount, sort of like a MakeShip situation. I know people really want this with the Sunback plushies (I am one of said people)

Well I do actually like this idea in theory (especially as a collector myself and someone who wishes they could have gotten some CS merch especially that adorable sunback plushie), I think unfortunately the actual execution of it would probably be way more difficult than it seems on the surface.

The immediate problem I see that would face this is copyright besides funding, popularity, or even where/how to make them; the majority of pets on the site are made by multiple artists, and while these artists give specific permission for their art to be used for specific purposes on CS such as pets or items, I doubt any of them have given CS specific permission for merch rights - the actual permission of copyright for merch and the ability to sell it is different then just general/specific use rights. This specific issue is where I can see this idea running into potential murky legal waters that I doubt the staff really want to deal with.

Obviously the immediate solution to the copyright issue would be to contact the artists to potentially obtain said permission, but this is easier said than done - considering the site as we know it was made back in 2008, many of the artists who have made art for CS throughout the years may no longer be reachable, which makes obtaining the permission unavailable let alone if that respective artist decides that they do not want give permission beyond the scope of what they have already given permission for - this means that depending on the artist it could be only a handful of pets that can't be used or entire years worth. Ultimately, a lot of this is probably just too much to realistically be added to the staff's plate unfortunately in addition to aspects like their daily lives and such.

(*obligatory apologies if there's any negative tone to my message as that's not intended, I do genuinely love the idea of this but I think there's just unfortunately a lot of hang ups which prevent ideas like this and other great merch ideas from happening such as financial or potential legal issues).

this would be cool.. but tbh i don't think there's anything stopping people from making something! cs is a community of artists and i think it'd be cool if people drew the cards as fanart. they probably wouldn't be printed which i think is the point, but i think fanworks are viable! but also i wish they made plushies of the ur pets,like the baby dragon and the galaxy cat. I would buy a galaxy cat plush no questions asked

as for concern re: legal issues, this would only be an issue with the cards utilizing the exact same linework/artwork - derivative artworks used for the cards would fall under fair use just like any other fanwork, fanzine, fan merch, etc that exists... which is what they should be doing any way, idk if i would buy a booster pack of cards that were just a copy-paste of the pngs on the site.

additionally, the odds of one of the artists who designed, say, the mime gupps trying to sue (let alone WINNING such a case) is very low: civil liability cases such as this one only work out in the claimant's favor if you can prove some sort of damage was incurred (in this case, monetary), and i don't think an artwork using lineart that often wasn't even the artist's to begin with, done for FREE in the first place, could prove any significant loss. the claimaint would be risking a lot of money in legal fees for little or no reward: there's no way these cards would generate a sizeable enough profit for even a small claims court, given the relatively small size of the chickensmoothie community. i'd also like to imagine none of the artists who have volunteered and were a part of the cs community to go out of their way to ruin such a positive little project idea in the first place.

another potential loophole could be making it a charity project! just like fanzines, people will place pre-orders so that during the production stage, there isn't a surplus made (ie there won't be an issue of unsold packs sitting somewhere taking space). all funds could be donated to an animal-related charity organization. :3
