You can commission fan art, but you can’t claim the character as your own.
You are requesting an artist draw you something specific, which is ok. It would be different if an artist started making and selling fanart (for profit) without any requests. As in, making a product for wholesale rather than a customized commission.
An artist you commission for original artwork does not need to give you access to their linework unless you have specifically asked them to ahead of time and they agreed. In fact, most artists specifically do not want you to trace or modify or recolor their work.
Generally commissions are expected to be original work (no pre made lines or bases) made specifically for the person who ordered it. You can then use the image as long as you give credit. Some artists don’t want their art used in certain places or want a specific mark of credit, so make sure you establish their policies before commissioning.
