Yes, they are. My partner will shout out the pokemon they see and we both are able to catch it. So it is more like a spawning point for people to interact with, and doesn't seem like you can 'steal' a pokemon from anyone either.
As far as Pokemon Go connection, and other problems: They are still working on the server to be honest! They came out of beta and were doing good with that, but it seems they were not honestly prepared for the extremely large group of people who are on it. So, they are ill prepared to handle the bulk of all these users.

I honestly went and just got a new phone. I actually had to uninstall nearly all of my other apps just to get Pokemon Go on the old one... And I was sick of having to clear the cache and delete apps just to update my favorite ones. Now I have one of the newest ones, so the only problems I forsee are my data usage (I already used my fast data up and now on the slow one till the 17th) and Pokemon Go server issues themselves.

Do you have a "partner" pokemon?
Eevee is always my go to pokemon, forever. So right now I have one Flareon, and four 100 - 160 cp Eevee. Once I am able to get Vaporeon and Jolteon I will work on my remaining eevee to be my true blue partner <3
