It's unfair to them ( rarity wise ), the three month rule comes into consideration here. However, malks do have a bit of value since they're an "expired" line art. But, it's up to you and the user to settle terms demand wise ( correct me if wrong.).

1. About fair maybe unfair to them a bit NM. its unfair to you because the swirl dog is a rerelease from 2008
2 . unfipaie to them. Items have rarities too

1. Swirl dog is a rerealese from August, 2009, so taking 3 month rule in account, it may be a tad unfair to the other user because their 2009 dog is from March, 2009.
2. store items claim pretty good value, I don't think a quantity of recent commons will be able to amount to item rarity.
3. Fair.
