Is this fair?
My dog is an 09' rare valentine's rerelease and theirs is 09' September rare.
I am just not unsure on how the three-month rule would play into this.
What should be added if this is unfair?

They definitely should add something, as Your pet is 7 months older, additionally it's from the litter that's slowly turning VR and I haven't seem many of them re-released. Their dog is quite common 2009 rare. I'm not sure what should they add, though, and don't want to give false advice. =)

What needs to be added or removed to fill the place of the missing non-tag?

The 2nd gen dog was available for a long time [until mid 2009 if I'm not wrong] and it's quite easy to find, so the 2009 dog only is enough. =)

No. Removing the statue dog wouldn't help much. The trade would still be unfair to the top. Those 2nd gens are only worth mid/late 2009 rares.
